＊鳩山システム

脱税を認めている鳩山だが、閣僚は総理が同意しないと起訴できないため鳩山の起訴には鳩山の同意が必要。
そもそも総理自身の在任中の起訴には滅多に出来ないのは今までも同じだがそれでも説明責任はあると考えてきた。
一方、鳩山は「捜査中だから説明しない」で説明責任から逃避。

●審議のあらすじ

棚橋「これっておかしいんじゃないの？起訴されることまず無いんだから
　　　説明責任を果たすべきだと思うけど、千葉法相はどう思う？」
千葉「個別のこと仮定のことには答える気は無い」
棚橋「仮定じゃなく現実に起こっている。個別が駄目なら一般論で答えて。
　　　　総理の違法行為がバレそうになったら誰かに告発させて
　　　　捜査中にしてしまう、すると説明もしなくて良い、起訴もされない
　　　　治外法権状態を発動できる鳩山システムは問題は無いのか」
千葉「それは治外法権ではない」
棚橋「法相として問題はあると考えるか否かYESかNOで」
千葉「答える気は無い」
棚橋「起訴を阻止することが鳩山さんには出来るが、それをするつもりはあるか？
　　　　また捜査官は貴方の部下だが捜査官に接触するつもりはあるか？」
千葉「答える気は無い」
棚橋「それって捜査への圧力を示唆していることになるが、否定しないのか。」
千葉「答える気は無い」
